Witness on a rental agreement
A witness is a third party who observes the landlord and tenant sign the rental agreement and signs it themselves to confirm the signing took place. In India witnesses are legally required on registered rental agreements; in the United States they are essentially never required for a standard residential lease, though some landlords add a notary block out of habit.
India: two-witness rule
- Under Section 68 of the Indian Evidence Act 1872 and the state Registration Rules, a rental or leave-and-license agreement presented for registration needs two attesting witnesses.
- Each witness must sign on the final page, print their name, and provide address and (commonly) an ID proof.
- Witnesses must be adults of sound mind and cannot be a party to the agreement.
- In Maharashtra, a leave-and-license longer than 11 months must be registered; witnesses appear before the Sub-Registrar.

What if the witness line is blank?
In the US, nothing — the lease is still enforceable. In India, an unregistered or unwitnessed leave-and-license agreement beyond 11 months is inadmissible as primary evidence of the lease terms under Section 49 of the Registration Act 1908 and Maharashtra's amended rules. It can be used only as a collateral document, which weakens eviction and rent-recovery cases.

In India, yes — two witnesses are required on a registered rental or leave-and-license agreement under the Registration Act 1908 and state Stamp Acts. In the US, witnesses are generally not required on a residential lease; only the signatures of the parties are needed for the contract to be valid.
Who can be a witness on an Indian rental agreement?
Any adult (18+) of sound mind who is not a party to the agreement. Witnesses sign on the final page next to their names and addresses. For registered leases the witnesses must appear before the Sub-Registrar along with the parties.
Does a notary replace a witness in the US?
A notary confirms the identity of the signer but does not sign as a witness to the content. Most US residential leases do not require notarisation either — a written, signed lease is enforceable without it. Long-term commercial leases are sometimes notarised for recording.
